Classification Standard for Foreigners working in China (Trial)
Establish a scientific and practical foreign talent evaluation system, focusing on ability, performance and contribution, highlighting market evaluation, international peer evaluation and other market-oriented needs (see The Description of Recognized Professional Achievement Standards for Foreign High-end Talents, hereinafter referred to as the Description of Achievement Standards). A comprehensive application of the points-based system (see the points-based element score assignment table), work guidance catalogue for foreigners in China, labor market testing and quota management, etc., divides foreigners working in China into three categories: A, B and C, and implements classified management according to standards.
I. Foreign High-end Talents (Category A)
Scientists, science and technology leaders, international entrepreneurs, and special talents urgently needed by China's economic and social development, who meet one of the following conditions for the introduction of foreign talents, will be classified as Class A, and "green channel" and "acceptance and acceptance" services will be implemented.
(1) those selected in the domestic talent introduction plan
The selected candidates of the talent introduction plan approved by the Organization Department of the CPC Central Committee, the Ministry of Human Resources and Social Security and the State Administration of Foreign Experts Affairs at or above the deputy provincial level (see Note 1 on achievement Criteria).
(2) conforming to the internationally recognized standards for the recognition of professional achievements
1. Nobel Prize winners (physics, chemistry, physiology or medicine, economics).
2. Winners of the following awards: NATIONAL Medal of Science, National Medal of Technology Innovation; Scientific Research Medal of the French National Scientific Research Center; British Royal Gold Medal; The Copley Medal; Turing award; Fields Medal; Wolf Prize in Mathematics; Abel Prize; Lasker Award; Crawford Prize; Japan International Award; The Kyoto prize; Shaw Prize; Distinguished Architecture Award (see Achievement Criteria Note 2); Prestigious Industrial Design Award (see Achievement Criteria Note 3).
3. Academicians of Chinese Academy of Sciences and Chinese Academy of Engineering.
4. Members, members or directors of international scientific and educational organizations, such as international Organization for Standardization (ISO) and other internationally renowned academic institutions (see Note 4 on Achievement Standards).
5. Director in charge and senior researcher of national institutes or laboratories of various countries.
6. Responsible person, chief scientist or principal member of science and technology projects of various countries.
7. Served as chief editor and deputy chief editor and senior member of international high-level scientific and technological journals (JCR I and II Area).
8. Published 3 papers as the first author or corresponding author (including equivalent author) in international high-level scientific and technological journals (journal Citation Report, JCR I and II Area).
9. Those who have held managerial positions above middle level or employed as professors or associate professors in high-level universities abroad.
10. Held senior management positions and key members of technology R&D in the headquarters of fortune 500 enterprises (see achievement Standard Note 5), held management positions above deputy general manager of secondary companies or regional headquarters, and held responsible positions of technology R&D.
11. Held senior management positions in internationally renowned financial institutions (see Achievement Note 6) and internationally renowned accounting firms (see Achievement Note 7).
12. Presidents, Vice-presidents and professors and associate professors of world-renowned colleges of Music, Fine Arts or art (see Note 8 on Achievement Criteria).
13. Principal conductor and voice player of a world-renowned orchestra (see Achievement Criteria 9).
14. Artists who have performed solo in world-renowned opera houses (see ACHIEVEMENT Statement 10) or concert halls (see Achievement Statement 11).
15. Won a famous literature (see the achievement standard 12), film, television, drama (see the achievement standard 13), famous music award (see the achievement standard 14), famous advertising awards (see the achievement standard 15) in the highest level of personal awards and the international famous art competition (see the achievement standard 16) a class competition prize, first prize or category Individual awards and judges of the above awards and competitions.
16. Famous athletes, head coaches or core members of coaching staff who ranked in the top 8 of the Olympic Games or the World Cups, World Championships and other important international events included in the Olympic Games in the past two times (see The Achievement Standard Note 17) and the top 3 of the Asian Games or the Asian Cups and Asian Championships included in the Asian Games in the past two times.
17. Held a leadership position at ministerial level or above in a foreign government agency, or held a senior leadership position in a well-known international or non-governmental organization (see Note 18 on Achievement Criteria).
18. Winners of world and national skills competitions or professionals engaged in the training of their competition projects; Highly skilled personnel with the highest level of international vocational skill qualification certificate or China's senior technician vocational skill qualification certificate.
(3) Foreign talents who meet the needs of market-oriented encouraged positions
1. Personnel with senior management or technical positions employed by enterprises and secondary subsidiaries of the central Government, global or regional headquarters of fortune 500 enterprises, national high-tech enterprises (recognized by science and technology departments at or above the provincial level), and large enterprises (see Note 19 on Achievement Standards).
2. Enterprise engineering research center (identified by the development and reform department), engineering laboratory (identified by the development and reform department), engineering technology research center (identified by the science and technology department), enterprise technology center (identified by the information department) and local technology innovation service
Platform (science and technology department identified) work with senior management or technical positions.
3. Medium-sized enterprises at home and abroad (see the achievement standard 19) hired by the persons with senior management or technical position or conform to the encouraged industries items in the catalog of foreign-funded industry guidance and the catalog of foreign-funded dominant industries of the mid-west region small entry retained by the chairman of enterprises with foreign investment, legal representative, general manager or chief technical expert.
4. Those who are employed as senior or above management positions in institutions of higher learning and scientific research, associate professors, associate researchers, senior lecturers, senior practice instructors and other professional and technical positions at deputy senior level or above.
5. Senior management or vice senior or above professional and technical positions are employed by domestic grade A general hospitals or municipal specialized hospitals at the vice provincial level or foreign-funded hospitals.
6. Chief conductor, art director and chief performer employed by domestic first-class orchestra and other art organizations (see Achievement Criteria 20).
7. Chief editor, deputy chief editor, chief announcer, senior host, planning supervisor, layout design supervisor and other senior management or technical personnel employed by central and local mainstream media (see Achievement Standard Note 21).
8. Main athletes, head coaches or core members of coaching staff hired by national or provincial sports teams or clubs.
9. Foreign talents whose average salary is no less than 6 times of the social average of the previous year.
4. Innovative and entrepreneurial talents
1. Founders of enterprises who have invested in major technological inventions, patents and other independent intellectual property rights or proprietary technologies with stable investment for three consecutive years, accumulative actual investment of the enterprise is not less than 500,000 US dollars, and their personal shares are not less than 30%.
2. Chairman of the board, legal representative, general manager or chief technical expert of an enterprise whose annual sales amount is more than 10 million yuan or whose annual tax amount is more than 1 million yuan for three consecutive years with the investment of independent intellectual property rights or proprietary technology such as major technological inventions and patents.
3. Personnel with senior managerial or technical positions employed by units listed in the list of innovative enterprises or the list of science and technology creation occupations formulated by relevant provincial departments.
Outstanding Young Talents Young talents under the age of 40 who are engaged in post-doctoral research in high-level overseas universities or universities within China.
(6) those with a point score of 85 or more
Ii. Foreign Professionals (Category B)
Foreign professionals who meet the work guidance catalogue and job requirements of foreigners in China and are urgently needed for the development of China's economic and social undertakings and meet one of the following conditions shall be identified as Class B.
(1) Foreign professionals with a bachelor's degree or above and 2 years or above relevant working experience. Conforming to one of the following provisions:
1. Managerial personnel or professional and technical personnel engaged in scientific research, teaching and management in special fields such as education, scientific research, press, publication, culture, art, health and sports.
2. The age requirements will be relaxed for personnel dispatched by internationally renowned academic institutions and international scientific and educational organizations in accordance with the provisions of the intergovernmental exchange and cooperation agreements for those personnel who carry out intergovernmental agreements between China and other countries, agreements between international organizations, and contracts on trade and engineering technology between China and other countries.
3. Employees of representative offices of international organizations in China and representatives of overseas expert organizations in China.
4. Middle-level and above employees dispatched by multinational companies, chief representatives and representatives of resident representative offices of foreign enterprises in China.
5. Foreign managerial personnel or professional and technical personnel employed by various enterprises, institutions and social organizations.
(2) Hold international general vocational skill qualification certificate or skilled personnel in urgent need.
(3) foreign language teaching personnel. In principle, foreign language teachers should be engaged in teaching the mother tongue of their native country, and have a bachelor's degree or above and at least 2 years of working experience in language education. Among them, those who have obtained a bachelor's degree or above in education, language or teacher education, or obtained a teacher's certificate in their host country or obtained a qualified certificate in international language teaching can be exempted from the requirement of working experience.
(4) Foreign talents whose average salary is not less than 4 times of the social average salary of the previous year in the region.
(5) specialized personnel and project implementation personnel conforming to the provisions of relevant state departments.
(6) Professionals who have scored more than 60 points.
Iii. Other Foreign Personnel (Category C)
Other foreign personnel who meet the needs of the domestic labor market and conform to the provisions of national policies shall be classified as Class C, mainly including:
(1) foreign personnel who meet the current regulations on the administration of foreigners working in China;
(2) foreign personnel engaged in temporary or short-term work (not exceeding 90 days);
(3) Personnel under the quota system shall include young foreign students who come to China for internships under intergovernmental agreements, foreign students who meet the prescribed conditions, foreign graduates of overseas universities, and foreigners working in special fields such as deep-sea fishing, etc.
